New watchdog agency reviewing payday lending

(AP) ? The Obama administration's new consumer protection agency held its first public hearing Thursday about payday lending, an industry that brings in some $7 billion a year in fees nationwide.

The Consumer Financial Protection Bureau said testimony from the session in Birmingham ? where City Council members recently passed a six-month moratorium on new payday lending businesses amid concern over their prevalence and high interest fees ? would help guide the development of future regulations.

Director Richard Cordray said the bureau recognizes the need for short-term loans, but the lending needs to help consumers, not harm them.

"Before this month, the federal government did not examine payday lenders," Cordray said. "Some state regulators have been examining payday lenders for compliance with their state laws. We hope to use our combined resources as effectively as possible."

About 19 million American households now have payday loans, officials said. With interest rates often in the teens and easy application procedures, lenders said they generate business through radio and television advertising, plus word-of-mouth and by locating offices in areas where other small-loan lenders are located.

Many in the standing-room crowd of more than 400 were lending company customers or employees who wore "I Choose Payday Advance" stickers provided by the industry.

Tanzy Bonner told a panel she got a payday loan to cover the cost of her 6-year-old's birthday party; LaDonna Banks said she got one because she couldn't work after donating a kidney to her brother.

"I borrowed the money, I paid the money back," Banks said.

Steven Hoyt, a Birmingham City Council member who supports the moratorium, urged the agency not to be swayed by such stories because the loans come with exorbitant interest fees.

"It's fleecing by any other name," Hoyt said.

The Consumer Financial Protection Bureau has been in the spotlight because of Republican opposition to its formation and President Barack Obama's use of a recess appointment earlier this month to tap Cordray, a former Ohio attorney general, as its director.

With GOP legislators blocking the nomination because they said the agency lacks sufficient congressional oversight, Obama installed Cordray ? a move that Republicans said was an unprecedented power grab. Democrats disagreed, saying Republican presidents routinely filled vacancies by the same process. Obama nominated Cordray after congressional Republicans opposed consumer advocate and Harvard University professor Elizabeth Warren becoming director.

Republicans kept up the criticism over the bureau's formation as Thursday's hearing began. The chairman of the Alabama GOP, Bill Armistead, said Cordray's decisions "could have devastating impacts on an already fragile economy."

"The last thing we need is another big government agency putting more regulations on our businesses," Armistead said in a statement.

Often criticized by advocates for the poor, payday loans are short-term, high-interest loans that work like cash advances. Storefront payday loan operations are prevalent in middle- to lower-income areas around Alabama, sometimes taking over closed convenience stores or fast-food restaurants.

Loan amounts in Alabama are capped at $500 by state law, which limits the maximum interest rate to 17.5 percent. An industry website said the annualized interest rate for a 14-day loan of $100 tops 456 percent.

In a typical transaction, a borrower writes a check for $117.50 and gets $100 from the payday lender, who holds the check for a short period before depositing it. If the customer needs the check held another two weeks, he pays another $17.50 fee.

Officials said more than 20 percent of Alabama households have taken out loans from payday storefronts or similar businesses at more than 1,000 locations statewide. Opponents said the businesses prey on people who lack access to traditional loans when they get in a pinch for cash.

"People get churned through the system six, eight, 10 times a year," said Stephen Stetson, a policy analyst at Alabama Arise, a Montgomery-based anti-poverty organization. "If we have laws against gouging for gas and water, we ought to have laws against gouging for loans."

The head of Ohio-based Community Choice Financial Inc., which operates in Alabama and more than a dozen other states, said the industry serves some 60 million people nationally and already is regulated by states, licensing requirements and federal disclosure laws. CEO Ted Saunders said he was offended by suggestions that payday lenders take advantage of poorly informed people.

"Listening to what you heard here today, you'd think my thousands of employees go to work every day to hurt their neighbors," he said. Rather than enacting sweeping federal rules, he said, states should concentrate on getting rid of "bad actors" in the business.

A Democratic state lawmaker in Alabama also expressed concern about the potential for new regulations, defending state oversight of the industry and arguing that low-income people need access to quick, easy-to-obtain loans. Many people can't walk into a bank and get a loan or withdraw money from an automatic teller, said Rep. Oliver Robinson of Birmingham.

"The people who live in my district don't have alternatives," Robinson said.

Carbonation brings diamonds to surface

Chemical reactions deep inside the Earth fuel magma?s gem-laden upward journey

Drop a Mentos candy in a bottle of Diet Coke, and carbon dioxide will bubble violently out of the soda. Similar chemical reactions may send certain kinds of magma frothing up from deep within the Earth, carrying diamonds along the way.

The discovery, reported in the Jan. 19 Nature, solves several mysteries about why and how diamond-bearing rocks appear where they do. As gem-laden magma rises, the theory goes, it gobbles a mineral called orthopyroxene, changing the magma?s chemical composition and belching carbon dioxide gas that drives its continued ascent.

?We?ve provided a simple, chemically reasonable process to have dissolved gas at depth,? says Kelly Russell, lead author of the new paper and a volcanologist at the University of British Columbia in Vancouver.

Diamond mines tap volcanic rocks called kimberlites, which contain many kinds of crystals that must have formed at high pressures 150 kilometers or more deep, in the planetary layer known as the mantle. How those mantle crystals make it to the surface has been a puzzle, since magma gets denser the more crystals it picks up. Most geologists have assumed that the magma must bubble gases to keep it moving up, but no one has been able to explain exactly how.

Russell and his colleagues realized that gas could do the trick if the magma starts out relatively poor in silicon dioxide, a major component of the Earth?s crust also known as silica. As magma rises through cracks it begins to dissolve the surrounding rock ? especially that containing lots of orthopyroxene, a mineral rich in magnesium, iron and silica. The orthopyroxene releases its silica into the magma, and as the silica content rises the magma?s ability to hold dissolved carbon dioxide drops. The gas bubbles out and by the time the kimberlite gets to the surface, it erupts at supersonic speeds.

Working in a high-temperature laboratory at the University of Munich, Russell melted sodium carbonate as a stand-in for silica-poor magma. He then added orthopyroxene and watched as the mixture furiously bubbled carbon dioxide.

The research could explain why the gem-laden kimberlites appear only in ancient parts of continents, known as cratons, like those in northwestern Canada and southern Africa. Cratons contain lots of orthopyroxene, allowing the magma to gobble it and ascend. ?We?ve always wondered, how do the kimberlites find the craton?? Russell says. ?They don?t. Their passage through the craton converts them.?

Lionel Wilson, an earth scientist at Lancaster University in England, says the study fits with other ideas about how kimberlites rise. In 2007, he and James Head of Brown University proposed that diamond-bearing magma moved upward by shattering rocks above it (SN: 6/30/07, p. 412). But their calculations showed it slowing down in shallower depths. The chemistry proposed by Russell?s team would give the magma enough oomph to continue all the way to the surface. ?So I see this as a really important contribution,? Wilson says.?

Russell?s team is now working to see how quickly orthopyroxene and other minerals dissolve in the magma, to better estimate the speeds at which kimberlites rise.

Between the 14th and 18th of October 2011 1,083 members of the goo Research monitor group aged twenty or older completed a private internet-based questionnaire. 50.1% of the sample were male, 19.9% in their twenties, 20.3% in their thirties, 20.1% in their forties, 19.5% in their fifties, and 20.1% aged sixty or older.

I used to be quite keen on getting one, as my point and shoot is getting a bit dented, but now I?ve got my smartphone with a passable camera and instant connectivity, my compact camera is now gathering dust, and a mirrorless SLR just feels like too much bother!

    America's Golden Girl rang in her 90th birthday with a splashy NBC special Monday night. Amy Poehler, Mary Tyler Moore, Hugh Jackman, and Tina Fey turned out to toast ? and roast ? White, recalling favorite memories from the star's seven decades in show business, praising her talent, and, more often than not, cracking wise about her old age. (Watch a clip below.) Here, four highlights from the big birthday bash:

    1. President Obama, the stand-up comic
    In a taped message to White, President Barack Obama delivered a cheeky birthday greeting: "I can't believe you're 90 years old. Will you please produce a copy of your long-form birth certificate?" Look,?says Margaret Eby at?Flavorwire. The "'birth certificate' gag is a little tired," but Obama's cameo "was charming, as was the closing shot of him putting a picture of White next to framed ones of Michelle and the kids."

    2. The many, many old lady jokes
    An entire red carpet's worth of celebrities dropped by to deliver glowing speeches in honor of White, says Sarah Anne Hughes at The Washington Post. But more often than not, they were there "for a night of jokes about age." Amy Poehler kicked things off by calling White a pioneer: "I call her a pioneer because 90 years ago she literally [traveled] to California on stage coach." Carol Burnett chimed in, "Like many of you, I first heard about Betty White from the wonderful stories told to me by my grandmother."

    3. "Thank You for Being a Friend"
    The special ended with a star-studded singalong, with those in attendance serenading White with a rendition of the Golden Girls theme song, "Thank You for Being a Friend." After a standing ovation, a clearly moved White "ended the night on a high note," says Hollywood Life. She said, "To be able to spend a lifetime in the business you love with the people you love ? and get away with it ? is marvelous!"

    4. A preview of White's next gig
    The special concluded with a preview of a new prank show produced by White, called Betty White's Off Their Rockers, which features senior citizens playing hidden camera tricks on youngsters. The "feel-good" series puts a fresh spin on the tired prank show genre, says The Huffington Post, because none of the victims in the clip actually got mad at the senior pranksters. Instead, the common response was "amusement, delight, or a shaking of the head with a smile." Actually, says Verne Gay at Newsday, this show looks?"worse than awful, painful, and sad." It was embarrassing, and "White's spectacular career shouldn't be reduced to this."

    XE.com - Dutch launch new tribunal for finance disputes

    THE HAGUE, Jan 16 (Reuters) - A new tribunal for the resolution of disputes involving complex financial instruments opened in The Hague on Monday, a bid by the Netherlands to win more business in the financial and legal services sectors.

    The Panel of Recognised International Market Experts in Finance - or PRIME Finance - is intended to settle disputes in the global financial markets, such as those arising from the collapse of Lehman Brothers in 2008 and the subsequent financial crisis.

    Lord Woolf, the former Lord Chief Justice of England and Wales, and Nout Wellink, who was president of the Dutch central bank at the time of the financial crisis, are on the new tribunal's advisory board.

    The panel's experts cover areas such as market practice, arbitration and mediation, and have worked at financial institutions, leading law firms, regulatory agencies and universities, specialising in derivatives, structured products, and collateralised debt obligations.

    The Hague has a reputation as a centre for international justice, particularly in instances where crimes against humanity cannot be tried in their home countries. The city is already home to several world courts including the International Court of Justice, the International Criminal Court, and other war crimes tribunals,

    But the Netherlands' position as an international financial centre was dealt a severe blow in the 2008 financial crisis, when the state had to stump up nearly 40 billion euros to rescue several financial institutions.

    Leading bank ABN AMRO had to be nationalised while ING Groep is still in the process of repaying state funds.

    The global crisis prompted some experts to call for a specialist tribunal to handle disputes arising from financial transactions involving more than one jurisdiction.

    'The PRIME Finance project emerged against the backdrop of financial market crisis and legal uncertainty,' said Jeffrey Golden, a visiting professor at the London School of Economics and Political Science, who is on the panel's management board.

    'The amounts at stake are staggering, the legal and contractual issues are complicated, and the volume of complex product cases is increasing,' he said in a statement.

    Golden said that national courts and ad hoc arbitration have not yet been able to build a unified, authoritative body of law.

    'Decisions are unpredictable, too decentralized, often taken too slowly, and not always enforceable in the parties' home jurisdictions.'

    However, some legal experts consider it unlikely that investment banks and financial institutions in the United States and United Kingdom will want to try out a new tribunal, rather than use existing courts in New York or London with which they are already familiar.

    Pennsylvania 'castle doctrine' protects man who shot his romantic rival

    No charges were filed against a Pennsylvania man who shot his wife's lover with a bow and arrow.

    A man who fatally shot his wife's lover with a bow and arrow won't face criminal charges, in part, because the state's expanded "castle doctrine" makes it legal to use deadly force on one's porch or deck, a prosecutor said Tuesday, Dec. 27.

    State police have repeatedly said they believed the 38-year-old Central City man acted in self-defense when he killed Tony Bittinger, 43, of Salisbury, on Oct. 9.

    Somerset County District Attorney Jerry Spangler formally announced Tuesday that he agreed with police and that no criminal charges should be filed against the shooter, who has not been named by authorities.

    The woman has told police and the media that she was still living with her husband, but hoped to marry Bittinger, at the time of the fatal confrontation outside the married couple's home.

    Trooper Joseph Dzral said at a news conference that Bittinger, accompanied by two brothers, drove nearly 40 miles to the home and had been drinking. Toxicology results from Bittinger's autopsy put his blood-alcohol content at 0.18 percent, or more than double the state's legal limit for drivers.

    Drzal said Bittinger had left a voice mail for the wife threatening "to put a hole in (her husband's) head." He approached the house and was swinging a 32-inch wooden club as he climbed the stairs to the porch, where he was shot with a compound bow and arrow, Drzal said.

    Spangler said prosecutors would have had to prove the woman's husband wasn't acting in self-defense to convict him of killing Bittinger. That would have been even more difficult given changes to the castle doctrine law earlier this year, Spangler said.

    The law formerly permitted deadly force against an intruder in one's home, but required a resident to prove he had attempted to retreat or flee before using such force outside the home. The revised law permits self-defense without retreat outside the home, which is where police said Bittinger was shot in the chest with an arrow.

    Afghanistan arrests British contractors with guns (AP)

    KABUL, Afghanistan ? Afghan police arrested two British private security contractors and two Afghan colleagues and ordered their company closed down after finding a cache of weapons in their vehicle, an official said Thursday. They are being held for investigation into illegal arms transport.

    Their detention spells the latest trouble for Afghanistan's dozens of private security companies that guard supply convoys, development projects and private businesses. President Hamid Karzai has ordered all the protection companies shut down by March, to be replaced by a unified government-run protection force.

    Police who stopped the contractors' vehicle at a Kabul checkpoint Tuesday found more than two dozen AK-47 rifles in a metal box covered by a blanket, Ministry of Interior spokesman Sediq Sediqi told a press briefing.

    All 30 weapons had their serial numbers scratched off, and the men had no permits for them, so police arrested all four men on suspicion of illegal arms transport, Sediqi said. He said the case has been sent to Afghanistan's attorney general for investigation.

    Authorities ordered the immediate shutdown of Afghanistan operations of their company, the international security consulting firm GardaWorld, and are questioning other company employees.

    "They have to pay all the dues they owe to the government of Afghanistan, and they cannot operate any more after that," Sediqi said.

    GardaWorld specializes in high-risk areas around the world, with offices in Iraq, Pakistan, Yemen and Haiti. It provided security for Afghanistan's 2005 National Assembly elections.

    The firm said Thursday that it was cooperating with the Afghan investigation. A statement indicated it did not own the AK-47s but was in the process of buying them through legal channels.

    "The weapons in question were being taken to be tested at a firing range before being purchased and properly licensed by GardaWorld," the company said. "We fully comply with all laws and regulations in our Afghanistan operations and are making every effort to work closely with the Afghan authorities to rectify the situation as soon as possible."

    A spokesman for the British Embassy said it was monitoring the case and providing consular services to the two British citizens.

    Afghanistan has been scrambling to train guards for its own government security service ? called the Afghan Public Protection Force, or APPF ? since Karzai late last year ordered all 103 private security companies closed by March 2012.

    Karzai has said the private security firms undermine the Afghan police and army forces, creating effective militias that often flout Afghan laws and regulations.

    Controversies caused by some contractors' behavior, ranging from violence to cultural insensitivity, has given the industry a bad name among many Afghans.

    In 2008, guards from the American security giant Blackwater Worldwide ? now known as Xe Services ? forced an Afghan soldier to the ground and handcuffed him after he refused to let their vehicle pass through a checkpoint.

    And in 2005, three DynCorp International guards assigned to Karzai's own protective detail caused a scene in the VIP lounge of the Kabul airport while awaiting a flight. "They had been intoxicated, loud and obnoxious," according to an internal company report. DynCorp, also a U.S. firm, fired the three guards.

    So far, 57 of the private security companies have been shut down in Afghanistan, Sediqi said Thursday. Another 46, half of them Afghan firms and half international, are still operating but officials have vowed to close them by March, according to the Interior Ministry.

    The new Afghan force will need to train 25,000 guards to take over all the work performed by privately contracted guards, according to a U.S. government report released in October.

    Recruitment has been slow. As of late last year, the APPF had only about 6,500 guards trained, the U.S. report said. The NATO force in Afghanistan has offered help to speed up the training of the Afghan guards.

    If the Afghan government is not ready to take over by March, there is a provision for 12-month extension that would allow the private firms to continue operating. Karzai originally set a deadline to shut down private contractors by the end of 2010, but it was pushed back to this year.

    UK police: Body found on queen's estate was murder (AP)

    LONDON ? British police are treating the discovery of a body on the queen's Sandringham estate as murder.

    A woman's body was found on the vast estate in eastern England on New Year's Day, and Detective Chief Inspector Jes Fry said authorities are examining missing person reports and unsolved cases around the country to see if there are any links.

    "We are at the very early stages of the investigation and it could be a complex inquiry," Fry said Tuesday. "The body had been there for some time."

    Authorities were doing a post-mortem Tuesday on the body.

    A member of the public found the body in a woodland at Anmer, a tiny village 115 miles (185 kilometers) northeast of London. The village is part of the Sandringham estate where the royal family spends some of its holidays.

    The hamlet of Anmer is home to several dozen people and sits around three miles (4.8 kilometers) from Sandringham House, which has served as a private residence for British monarchs since 1862. Queen Elizabeth II and her husband Prince Philip spent part of the holiday season there and were at Sandringham House on New Year's Day.

    Sandringham Estate's website says the entire estate is spread over 8,000 hectares (19,768 acres) in Norfolk. Sandringham House and its gardens make up 24 hectares (59 acres), and there are 240 hectares (590 acres) of woods and open countryside in a section that is open to the public free of charge all year.

    There are also two stud farms and a fruit farm. The estate employs over 100 full-time staff.

    Buckingham Palace referred all questions about the body's discovery back to police.

    So far, battery cars coming up short

    If the White House hopes to meet its ambitious goal of putting 1.5 million battery cars on the road by mid-decade it better hope that 2011 wasn?t a good indication of what Americans think of electric vehicles.

    Add them all up, hybrids, plug-ins and pure battery-electric vehicles, or BEVs, and they accounted for little more than 2% of the U.S. automotive market last year.? Remove conventional gas-electric models, such as the Toyota Prius and Ford Fusion Hybrid, from the equation and more advanced battery vehicles generated barely 20,000 sales.

    ?I?d say they failed,? proclaims Joe Phillippi, chief analyst with AutoTrends Consulting.

    For his part, David Sullivan, of AutoPacific, Inc., isn?t quite ready to go that far, but he sees 2012 as the really critical year.? The limited demand for electric vehicles, so far, has largely been driven by the early adopters, contends Sullivan.? ?Now we?ll see if there?s broader consumer demand.?

    That?s going to be critical as the industry ramps up battery car production capacity and an assortment of new models charge into showrooms.

    While there are a variety of products already on the market, most come from niche manufacturers that barely even register on the sales charts.? Last year brought the introduction of two closely watched mainstream models: the Chevrolet Volt plug-in hybrid and the Nissan Leaf BEV.

    General Motors had declared a goal of selling 10,000 Volts but will likely end the year at around 7,000.? The good news for the maker was that momentum had been building during the final quarter but then Chevy found itself in the uncomfortable position of having to explain why several Volts caught fire weeks after being subjected to federal crash tests.

    Though there have been reports that last month?s sales were down sharply, GM spokesman Rob Peterson contends, ?December sales are solid ? definitely not ?down sharply? as reported.?

    But there?s no question the timing of the news was bad, coming just as GM was getting ready to boost production to 60,000 for all of 2012, 45,000 of those earmarked for the U.S.? The results of an investigation into the problem by the National Highway Traffic Safety Administration could clear Volt ? or cause it significant problems if a redesign of its battery pack proves necessary.

    Nissan came closer to its 2011 target, though it will likely fall a little short of the 10,000 mark when December sales are revealed later this week.? The maker can explain at least some of that away by pointing to the March 11 Japanese earthquake and tsunami that interrupted production for several months.? But Leaf sales have been slipping for several months, a worrying sign as Nissan prepares to open a new facility in Smyrna, Tennessee capable of churning out 200,000 battery cars annually.

    There are a number of reasons why proponents believe American buyers aren?t plugging into battery cars.? For one thing, there?s still a relatively limited range of choices available.? But that won?t be an excuse in 2012.

    The options coming to market are broad, ranging from the Fisker Karma, a plug-in sports car, to the Ford Focus Electric.? There are electric minicars, like the new Mitsubishi i, and big SUVs, including the Jeep Grand Cherokee and Mercedes-Benz ML350 that Ohio-based Amp Electric is converting to run on battery power.? There will be mainstream offerings, such as the Toyota RAV-4 Electric, and products from aggressive start-ups, such as Tesla?s new Model S sedan.

    The Model S will aim to overcome one of the biggest drawbacks of battery power, offering buyers a choice of a base Model S with a range of 160-miles, or optional 230- or 300-mile battery packs, the latter adding $20,000 to the price tag.? Most other pure BEVs are limited to less than 100 miles per charge.

    Even then, they aren?t cheap, battery vehicles saddled by price tags that are thousands ? in some cases, tens of thousands ? of dollars more than comparable gasoline vehicles.

    That might make sense had fuel prices held at the near-record levels seen in early 2011, but gas has dropped sharply since then.? Meanwhile, manufacturers have been making major strides when it comes to the fuel efficiency of conventional, gas-powered vehicles.? In the compact segment where Ford will compete with the Focus Electric, for example, 40 mpg on the highway is the new norm.

    Both government bureaucrats and electric vehicle manufacturers, says analyst Sullivan, ?aren?t giving consumers credit for being able to do the math.? It just doesn?t make economic sense? to buy an electric vehicle ? at least if your primary goal is to save money by reducing your energy bills.

    There are, of course, other reasons.? There?s the desire to clean up the air and to curb oil imports, especially from the Mideast.? But whether that can be used to draw more buyers into the market remains to be seen.? Especially in this economy, value is the big motivator, rather than politics and social concerns.

    So, the industry will have a big challenge ahead finding ways to lure customers into the showroom and getting them to drive off in a hybrid, plug-in or battery-electric vehicle. The past year certainly didn?t live up to expectations.? So, the coming year will be the big test.

    NASA marks 2012 with twin probes in moon orbit

    (AP) ? NASA kicked off the new year with a pair of probes circling the moon in the latest mission to understand how Earth's closest neighbor formed.

    There was no champagne popping in the mission control room at the NASA Jet Propulsion Laboratory when the Grail spacecraft arrived back-to-back over the New Year's weekend, but several scientists and engineers celebrated by blowing noisemakers.

    "It's a really good feeling to have not one but two of our twins in orbit," project manager David Lehman said Sunday after the mission was deemed successful.

    The action began on New Year's Eve when Grail-A swung over the south pole, fired its engine and braked into orbit around the moon. Not to be outdone, its twin Grail-B executed the same maneuvers on New Year's Day.

    The arrivals capped a roundabout journey spanning 3 1/2 months and covering 2 1/2 million miles.

    The moon has long been an object of fascination. Galileo spotted mountains and craters when he peered at it through a telescope. Poets and songwriters looked to the moon as a muse.

    Even governments wanted a piece of the moon. Since the dawn of the Space Age, more than 100 missions launched by the United States, Soviet Union, Japan, China and India have targeted Earth's companion. NASA flew six Apollo missions that landed twelve men on the lunar surface and brought back more than 800 pounds of rock and soil samples.

    Despite all the attention, the moon remains mysterious. Mission chief scientist Maria Zuber of the Massachusetts Institute of Technology said researchers know more about Mars, which is farther away from the Earth, than the moon.

    One of the enduring puzzles is its lopsided shape with the far side more hilly than the side that Earth sees. Research published earlier this year suggested that our planet once had two moons that crashed early in the solar system's history and created the moon that graces the sky today.

    Scientists expect to learn more about how the celestial body formed using Grail's gravity measurements that will indicate what's below the surface.

    Since the washing machine-size Grail probes ? short for Gravity Recovery And Interior Laboratory ? were squeezed on a small rocket to save on costs, it lengthened the trip and took them 30 times longer to reach the moon than the Apollo astronauts, who took a direct three-day flight.

    Previous spacecraft have attempted to study the moon's gravity ? about one-sixth Earth's pull ? with mixed success. Grail was expected to give scientists the most detailed maps of the moon's uneven gravitational field and insight into its interior down to the core.

    Data collection won't begin until March after the near-identical spacecraft refine their positions and are circling just 34 miles above the surface. While scientists focus on gravity, middle school students will get the chance to take their own pictures of the moon using cameras aboard the probes as part of a project headed by Sally Ride, the first American woman in space.

    There's already chatter about trying to extend the $496 million mission, which was slated to end before the partial lunar eclipse in June. Scientists initially did not think the solar-powered probes would survive that long, but changed their minds during the long cruise to the moon after getting new data.

    Researchers expect Grail to return a plethora of data, but that information won't be a guide to manned lunar missions anytime soon. The Obama administration last year scrapped a plan to return astronauts to the lunar surface in favor of landing on an asteroid as a stepping stone to Mars.

    Time runs out on Microsoft smart watches

    Microsoft?s Smart Personal Object Technology, also known as SPOT, was?originally unveiled by Bill Gates a decade ago. It was a neat concept ? using FM transmissions to deliver lightweight data services such as news headlines, sports scores, gas prices and weather to devices. It started with watches and later expanded to GPS navigation units and?even a coffee maker.

    Of course, it was our phones that ended up being the smart devices in our lives, giving us all of that information and more via cellular and Wi-Fi networks.

    And yesterday marked the official end of the Microsoft initiative, as the?MSN Direct service that powered the devices went dark, as?noted by Engadget.

    (Msnbc.com is a joint venture of Microsoft and NBC Universal.)

    The end of the service was not a surprise. Sales of the watches were discontinued in 2008, and MSN Direct?s Jan. 1, 2012, end of life was announced in October 2009. The SPOT initiative was long ago?relegated to the status of flop.

    I?ve covered this one almost since the beginning, and remember listening to Bill Gates as he demonstrated his watch to a group of reporters at a small gathering after the SPOT unveiling in Las Vegas.?Even back then,?Gates seemed to realize that it was a bit of a novelty product, in part because of the bulky designs of the first-generation watches, but also in a broader sense.

    The watches and follow-up devices pointed accurately to a future of connected devices, but in the end they weren?t the right implementation to connect with mainstream consumers.?It?s an example of Microsoft having a good sense for where technology was headed but not clearly seeing how people would incorporate the connected world into their everyday lives.

    But hey, let?s give the company some credit for at least attempting to do Dick Tracy proud.

Easton and husband, Gary of Rio Rancho, NM; grandson, Travis Easton and wife, Maggie of Monument, CO; granddaughter, Brandy Seader and husband, Brian of Rio Rancho, NM; great-granddaughters, Makenna, Morgan, Madison and Brynnley Seader, Sophia and Rebecca Easton. Mrs. Jennings was preceded in death by her husband, William G. Jennings, sons, William J. and Richard C. Jennings. A service will be held on Saturday, December 31, 2011, 10:00 a.m., at French - University Chapel. Interment will follow at Fairview Memorial Park Cemetery. Mrs. Jennings' family would like to thank her caregivers at Casa de Shalom for their extraordinary and compassionate care and they would also like to thank Hospice of New Mexico.     2012 Tablet Spending Spree By SMBs Predicted (NewsFactor)

    Tablets are high on the 2012 shopping lists of small- to mid-sized business hardware buyers at companies based in the United States, according to NPD Group's latest SMB survey. And Apple's iPad remains the top preferred brand among purchasing decision makers at U.S. companies with fewer than 1,000 employees, which collectively employ 121 million people.

    NPD reports that 73 percent of the nation's SMBs overall intend to spend more on tablets in 2012 -- up from 68 percent of the respondents to a similar NDP survey conducted in this year's second quarter. Moreover, 90 percent expect to spend the same amount or more on tablets over the next 12 months.

    Though many industry observers have predicted that the rising sales of tablets would lead to PC cannibalization, NPD's latest survey demonstrates that less than 20 percent of SMBs overall expect to cut their PC purchases during the year ahead.

    "Spending continues on PCs, and on tablets, and few companies -- even the smallest ones -- are significantly reallocating their spending away from the personal computing needs of their employees," said NPD Vice President Stephen Baker.

    "As we head into 2012, the SMB market continues to provide an important source of volume and dollars to the PC market," Baker wrote in a Thursday blog post.

    SMB PC Spending Intentions

    According to Baker, the heightened interest that SMBs have expressed about acquiring tablets for their employees next year by no means equates to the death of the PC market.

    "The combination, however, of the length of time since the Windows 7 launch, the need to spend on higher cost infrastructure, and the increased spending on tablets has clearly put a crimp on PC spending intentions -- especially among the largest firms," Baker explained.

    NPD's SMB Technology Monitor reports that 36 percent of the businesses surveyed with fewer than 50 employees said they expect to increase their spending on PCs during the year ahead. Moreover, Baker observed that their average spend of $3,400 would equate to upgrading 10 percent to 15 percent of each firm's PC base.

    Only 23 percent of SMBs with 501-999 employees expect to spend more on PCs in 2012, with the average spend approaching $75,000. According to Baker, this would likewise equate to replacing around 10 percent to 15 percent of the installed base at these larger firms.

    Apple Leads the Field

    By contrast, 89 percent of U.S. SMBs with 501 to 999 workers plan to make new tablet purchases next year. What's more, a significant majority of companies with 201 to 500 employees (81 percent) and 50 to 200 workers (70 percent) intend to follow suit. And at the smallest companies with less than 50 workers, 54 percent plan on making new tablet purchases and with 88 percent expecting to either increase or maintain 2011 spending levels.

    "Businesses of all sizes appear to be determined to capitalize on the tablet phenomenon," Baker said. "NPD's research shows that iPad purchase preference is higher among larger firms than smaller ones, which is an important indicator that Apple is gaining traction far outside its typical consumer space."

    NPD's new survey did not attempt to gauge the impact that Microsoft's forthcoming Windows 8 operating system for PCs and tablets might have on the 2012 purchasing decisions of SMBs. "We ask about what people intend to do now and what their plans are based on what they know today," Baker said in a Thursday e-mail.

    In other words, NPD did not ask respondents "to speculate on what they might do under a different set of circumstances in the future" nor query "about any potential impact of Windows 8," Baker added.

Though I advise they talk with their doctor before making any such change, it?s interesting to think that interacting with pets can help people manage their health.

    These were people who had either recently lost a long-time spouse or had anxiety about an upcoming surgery. Even something as non interactive as fish tanks in senior care facilities, especially Alzheimer units, have been shown to greatly reduce anxiety. Aquariums have also been shown to improved patients? eating habits and help them maintain their weight, which tends to be an issue for those afflicted with Alzheimers. Staff have even reported less ?incidents? by patients when a pets are present in the facility.

    Doctors are increasingly harnessing the power of pets to make a positive difference. They now understand that pets keep people happy and healthy and provide positive biological benefits? something us pet owners have known all along.
